These Terms of Use ("Terms") govern your access to and use of the website at tlm-marine.com (the "Website"), operated by GKM World OÜ, an Estonian company, under the TLM Marine brand. By accessing the Website you accept these Terms. If you do not accept them, please do not use the Website.

"We", "us", and "our" refer to GKM World OÜ acting through the TLM Marine brand.

2. Scope of these Terms

These Terms cover use of the Website itself — browsing pages, submitting our enquiry form, and viewing content. They do not constitute, by themselves, a contract for the sale of a yacht, brokerage service, ownership programme, or any other commercial agreement. Such transactions are governed by separate, individually negotiated written contracts.

3. Information on the Website

We take care to provide accurate information about Monachus Yachts models, specifications, pricing, and availability. However:

• Yacht specifications are subject to change by the manufacturer (Monachus Yachts) without notice. Final builder's specifications are confirmed in the build contract.
• Prices shown are indicative and exclude VAT, registration, transport, commissioning, and optional equipment unless explicitly stated. Final pricing is confirmed in a written quotation.
• Photography may show optional features that are not part of the standard package, or different colour schemes than the standard offering.
• Availability of pre-owned yachts is updated when known, but yachts can be sold or withdrawn quickly. Always confirm current availability before travel.

Nothing on this Website is a binding offer in the legal sense. A binding offer is made only when we provide a written quotation signed on behalf of GKM World OÜ.

4. Permitted use of the Website

You may use the Website for personal, non-commercial purposes related to learning about and engaging with TLM Marine. You may not:

• Reproduce, republish, or commercially redistribute any text, photograph, video, code, or design element of the Website without our prior written consent.

• Photography and product imagery of Monachus yachts is provided under licence from Monachus Yachts (Marina Kornati d.o.o., Croatia). The Monachus brand and its yacht model names are trademarks of Monachus Yachts.
• Editorial text on this Website is original to TLM Marine and is protected by copyright.
• The Website's technical implementation (HTML, CSS, JavaScript) is original to GKM World OÜ.

Nothing on the Website grants you any licence to use these materials. Limited fair-quotation use under Estonian copyright law (Autoriõiguse seadus) is permitted with attribution.

6. Third-party content and links

The Website includes links to and content from third-party services:

• Photography and CDN-hosted images from monachusyachts.com
• Video streaming from Bunny CDN
• Typography from Google Fonts
• Future links to our social media channels and partner sites

We are not responsible for the content, accuracy, availability, or privacy practices of third-party services. Visiting an external link is at your own discretion.

The contact form on this Website lets you request information or arrange a private viewing. By submitting it, you confirm that:

• The information you provide is accurate and provided in good faith.

• You consent to be contacted by GKM World OÜ in reply to your enquiry, through the channels you provided (email or telephone).

We aim to respond within one business day. Response time is a target, not a guarantee. We reserve the right not to respond to enquiries that are evidently fraudulent, abusive, or unrelated to our services.

8. Availability of the Website

We work to keep the Website available 24/7. Occasionally it may be unavailable for maintenance, updates, or due to circumstances beyond our control (hosting provider issues, network outages, force majeure). We do not warrant uninterrupted availability and accept no liability for losses arising from temporary unavailability.

We take Website security seriously. If you discover a vulnerability, please report it confidentially to info@tlm-marine.com with "Security report" in the subject. We commit to acknowledge your report within five business days. Please do not exploit vulnerabilities beyond what is needed to demonstrate them, and do not disclose them publicly before we have had reasonable time to address them.

13. Changes to these Terms

14. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict-of-laws provisions. Any dispute arising from or relating to these Terms or your use of the Website that cannot be resolved by good-faith negotiation will be resolved exclusively by the Harju Maakohus (Harju County Court) in Tallinn, Estonia.

If you are a consumer resident in another EU member state, mandatory consumer-protection rules of your country of residence remain available to you.

15. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with the Privacy Policy and Cookie Notice, constitute the entire agreement between you and GKM World OÜ regarding your use of the Website.
